Suit: City lied about Prospect Park West bike lane

The city threw pedestrians into the “lane” of fire by fudging Prospect Park West bike path data and colluding with rabid advocates to stanch opposition, a bombshell lawsuit alleges.

Neighbors for Better Bike Lanes and Seniors for Safety, two groups that oppose the lane, filed a lawsuit on Monday in Brooklyn Supreme Court, claiming that the “experimental” project has created dangerously “inconsistent traffic patterns” and “limited visibility” for everyone on the busy street.

The lawsuit demands that the lane be dismantled and calls for a truly independent study of traffic and safety conditions along the roadway.

“[The city] promised a thorough and objective study, and instead we got a coordinated effort to mislead the public and openly attack people concerned about safety conditions,” said Seniors for Safety President Lois Carswell.

Court documents paint a cozy relationship between lane supporters and Ryan Russo, the Department of Transportation’s assistant commissioner for traffic management — an official responsible for “interpreting and presenting the … misleading and skewed data,” according to court papers.

Last June, the group discovered through the Freedom of Information Act, that Russo told bike blogger Aaron Naparstek that the lane was “under serious attack [from] important people talking to other important people.”

The reference to “important people” is to former Transportation Commissioner Iris Weinshall and former Sanitation Commissioner Norman Steisel, who are both part of the opposition.

Russo told Naparstek that their anti-bike–lane efforts needed “neutralizing.” After Naparstek called lane the opponents “shameless, selfish pigs,” Russo wrote, “That’s quite enjoyable.”

The lane foes’ lawyer called the exchange “the tip of the iceberg.”

“The serious misconduct of these Transportation officials is a breach of the public trust and deserves further investigation and sanction,” said the lawyer, Jim Walden, who has contributed to the election campaigns of Sen. Charles Schumer — the bike-loving lawmaker who is married to Weinshall.

Department of Transportation officials would not comment specifically about the e-mail exchange, but said it has been in conversation with both sides of the issue.

“We always talk to supporters and to opponents to get the facts out on an issue and to advocate for policies we believe can best serve the city,” spokesman Seth Solomonow said. “The record here clearly shows that we spoke with people on all sides of this topic. We provided data to the community board earlier this year and categorically reject any claim that it is inaccurate.”

Lane supporters fired back on Tuesday, rallying at City Hall to decry the lawsuit as meritless and herald the lane as a driving factor behind a drastic, 63-percent reduction in accidents along the grand boulevard.

“Everyone is entitled to their opinion, but I believe this lawsuit disregards the opinions and jeopardizes the safety of the community,” said Councilman Brad Lander (D–Park Slope).

Some seniors for safety were on hand — to cheer the lane.

“I use the bike lane whenever I get the opportunity,” said Gene Aronowitz, 73. “Aren’t I entitled to be safe as I ride the streets?”

Lane backers added that there is no evidence to show that the city acted in an arbitrary or capricious manner.

“In fact, there’s plenty of evidence to the contrary,” said Gary Reilly, a Carroll Gardens resident and lawyer.

The city originally pitched the controversial two-way lane in 2009 as a traffic-calming measure that would reduce speeding on the hectic throughway. But backers pointed out that as far back as 2007, CB6 petitioned the city to install the protected path as a way to slow speeding traffic.

Despite opposition, the lane was painted last spring, and the Department of Transportation has consistently trumpeted it as a success, presenting data that shows fewer cars now speed, fewer bicyclists use the sidewalk and fewer cyclists get into accidents.

The city is moving to dress up the lane, and plans to add an array of safety measures, raised pedestrian islands and rumble strips, alerting cyclists to yield. New trees are also being contemplated. On Thursday night, CB6 was set to weigh the changes, which could be implemented this spring.

Critics, such as former deputy mayor Norman Steisel, said the measures are akin to putting lipstick on a pig.

”You’re talking about physical and cosmetic improvements,” he said. “My problem is fundamentally with the current lane configuration.”

I'm amazed that this is still an issue. Every single time people complain about this bike lane, five times as many people voice support. I grew up in Park Slope and a safer Prospect Park West was a common neighborhood dream for years. Now that this wonderful improvement has finally happened the city's worst former DOT commissioner and her friends are intent on using their elevated influence to bypass the community's best wishes. I can't believe I used to be proud to live in the same neighborhood as Schumer. Never again in the voting booth for these spoiled brat sore losers.

Hey, Brooklyn Paper - not a single mention of *who* makes up NBBL?

We're talking about a small organization whose main members are Lois Weinshall (former DOT commissioner), Norman Steisel (former Sanitation Commissioner), and Louise Hainline (dean at Brooklyn College). 3 people used to driving everywhere, and parking easily with the parking placards they've received (legally or not). All live along Prospect Park West, and all have complained about the inconvenience because they find it harder to illegally double park along PPW.

This isn't about safety. This isn't about procedure. This is about a small minority of politically well-connected people (Weinshall is also Senator Chuck Schumer's wife) fighting to rip out something that inconveniences *them*, regardless of it's incredible benefit to the community.

How come there's absolutely no mention of NBBL's makeup in your article? This isn't about widows and orphans suing against the terrible machine of the DOT. This is a bunch of spoiled whiners who want to game the system to get their way at the expense of the community.

Surreal. In normal land, seniors would be suing to stop the removal of a bike lane along a park to make way for a high-speed three lane road that imperils the safety and quality of life for all. But in Iris Weinshall's Park Slope, they're suing for the exact opposite.

Louise Hainline is a dean at Brooklyn College and signed her name to this. If it were an academic paper, she'd lose her tenure.

This is truly shameful. A project that most people love and that has saved lives and made the neighborhood more pleasant is being challenged, pro bono, by a group of rich people. Hainline lives at 9 PPW, where apartments sell for upwards of $3 million. She's costing our city millions at a time of terrible budget crisis.

Shame on her. We need better neighbors.

What the plaintiffs couldn't accomplish in the court of public opinion they are now trying to accomplish at taxpayer expense in the judicial system. You don't need to have extensive surveys by DOT with electronic equipment to verify that PPW is now significantly safer. It is apparent to the naked eye and ear. Traffic is noticeably slower, calmer and quieter with less weaving, high speed passing, and racing to the next light. This might upset those who think that unfettered use of an automobile is a divine right, but the greater good of the community is served by the bike lane.

They claim only 215 members between NBBL and Seniors for Safety, although many are members of both groups, so the numbers may be smaller. 215 people out of tens of thousands in Park Slope and the general area.

They only got 50 or so people to come to their rally. "Radical bike activists" had hundreds. At the last CB6 meeting, the ratio was about the same.

No matter what happens anywhere, there will always be a minority of people opposed to something. This time, that minority is made up of well-connected, rich people who are costing the city millions. They need to stop this, respect the public process and public opinion, and work on solving bigger issues.

These people have no interest in sacrificing one or two parking spaces every couple of blocks in order to make the neighborhood safer. Selfish selfish selfish. Some of them are so old that they are fighting a battle most of them won't be around to see for very long. It's sad.

Steve, According to the survey, half of the people who live on PPW don't like the bike lane, and 30% of park slope don't like it. While that is not a super majority, its also not a couple of fat cats like you and others are claiming.
Now, it may be true that the fat cats are the ones filling the suit, its also may be just, if not more likely, that they are the ones with the actual means to bring the suit, that at least half to the people who live on PPW agree with and at least roughly 30% of park slope in general agree with. Its not three people in a room like you are trying to argue.
As for the number at the rally, the bike people had more because they are organized city wide and they can bring in people from around the city, and they do this at other bike rallys.
The anti-bike lane people are all from one hood. People are not getting on the BQE and coming to park slope form Queens to protest a bike lane. So your numbers game is really bogus on its face.

If any of the people against you on this issue have a job that is somehow relevant to this issue, then what do you do for a living? What is your background and what is your character? Have you ever been arrested? Have you ever been fired? Have you ever had a chemical dependency problem? Have you had an extra-martial affair? Where do you live and how much did you pay for it?
Clearly, if that information is important to the merits of the bike lane, since you seem to think what the people on the otherside of this argument do for a living is so relevant to this issue, then you need to provide the same information about yourself. Will you do so, or will you be a coward?
So please, tell us what makes you sooo much better and honest than them? What? Anything? What a smaller paycheck means you are a better person, is that your argument? Come on, tell us?

I've gone jogging in the Park loop behind Lois and her personal secretary and listened to them complain about Progressives and Democrats in the neighborhood, trying to tell them what to do. Newsflash: in a democracy, elected representatives work for the People, not command them. If you don't like it, then move to Texas or some other similar state where everyone secretly longs to live in a dictatorship.

I love the PPW bike lanes. They slow down traffic to the point where I feel reasonably sure my kids can cross them without getting killed. That was not true before. If Lois succeeds in removing the bike lanes and returning PPW to the kill zone it was before, I will head the committee to help them get the hell out of our neighborhood. Forcibly.

The bike lane went through the normal community board review. The local politicians have all supported it. Not Marty but then he isn't a local politician. he doesn't like the neighbors at the Park in Coney Island either.
There are surely emails between people. Whether they were a "close relationship" characterizes the emails...in a way to support the lawsuit? BTW The arbitrary and capricious standard is as long as the DOT had any reason(whether you like it or not) the courts generally defer to them as the experts. The lawsuit has a tough road(pun intended) to carry before it wins. BTW the City uses in house Corporate counsel....it won't cost millions to get to a decision(probably one day in court and a couple of fruitless appeals)....

As a car driver and a bicyclist in Brooklyn the truth is that I think we all need to get over our selfish wants and needs and think about the overall safety of the people on them. Bikes should not run over pedestrians, cars should not run over bikes. The pedestrians get the sidewalk to use safely without the threat of both cars and bikes. As the number of bikes is expanding exponentially in Brooklyn we need to think about the safest way to share the roads between bikes and cars. Is this a bike lane? I'm not sure but this senseless polarized arguing doesn't seem to be getting us anywhere.

Yes, the emails were sent. It makes sense that DOT's bicycle program would be working closely with local pro-bike organizations to promote awareness and develop grassroots support for bicycle infrastructure improvements. I think anyone would be surprised if they WEREN'T working together.

Also, DOT's policy director used to be the ED for Transportation Alternatives and Tri-State Transportation Campaign.

Also, I thank Anthony Weiner for standing up to JSK and seeing her for who she really is on bike lanes just like how he did to Bloomberg on congestion pricing. If I was living in the city, I would vote for him for mayor. As for the lawsuit, I wish the best of luck for NBBL. Those who hope it will fail sound just like those who have naysayed DDDB on theirs' in the past, and hope that the one next week will fail as well. At least we know that the opposition is homegrown and not transplanted as what radical cyclist groups such as Streetsblog and TA do to help inflate their numbers in the claim that they always outnumber.

The bike lane is awesome. Schumer's wife is like a giant baby taking away the bike lane from the little people because she has in her head that it makes PPW less safe. I mostly surprised that I now have a reason to not vote for Chuck. I hope there is a Democratic Contender in the next Senate race in favor of bike lanes...and the little people.

Also, small point but, maybe the smoothie, muffin, dumpling, ice cream truck could park somewhere other than the corner of PPW and GAP in front of a fire hydrant. These trucks inhibit the flow of traffic and hurt visibility on that corner.

(1) 20-25% of bicyclists believe they are death proof and ride as if that was true. Headphones? Expecting cars to yield [in Brooklyn - really now]? Turing in front of cars in traffic? Nearly taking double forward flips head first by narrowly missing pedestrians? No helmets? Coaster brakes used by adults? Not looking over shoulder or using a mirror before taking wide turns or swinging out into traffic? Ignoring traffic signals and stop signs and then being annoyed when the world doesn't? You name it, I've seen it. And I ride a bike, just not in the above manner. If I did I would fully expect to end up in traction.

(2) To park along the bike lane you have to PULL into it or else risk getting T-boned by a livery cab, especially on the stretch nearest Grand Army Plaza.

Second, best performance art for free moment: the lady who proclaimed that the biggest threat to her safety was "blue haired ladies so busy adjusting their mink stoles" that they might door her. I have lived in park slope for a long time. Take it from me: we have neither blue haired ladies nor mink stoles.

I did not get to speak, but this was my statement:

I am "PRO" bike lane but I am not a biker. I am certainly not a member of the "Bike Lobby"

Even thought I live on 8th Ave so I hope my opinions count as much as those who live on PPW.


I represent 2 organizations.

First I am a member of the Prospect Park Track club. As a pedestrian, the Class 1 bike lane makes it easier to cross the street. As one approaches the bike lane from either direction one can easily see if a bike is coming for blocks. The stripped zone between the parked cars and the bike lane give more than enough room to see past even the tallest SUV. This stripped zone also gives drivers room to get out of their car with out "dooring" a bike.

I am also a member of the Automobile Association of America. As a driver I am glad to see the bikes off the road and onto their own protected bike lane. PPW is now one road were I don't have to be worried about a bike swerving in front of my car because the rider is about to be doored or because a Fresh Direct truck is using the dangerous Class 1 bike lane to store their vehicular while unloading.

I was born and raised in park slope brooklyn and see no need for a bike lane outside prospect park when you can ride inside. These bike lanes slow up traffic, make more stand still ,congestion and more ppollution. I drive and ride a bike for years. And it has not made much of a diffrents at all.
